I didn’t know they could do that! I am no lawyer… and I suppose, given the antics of our judiciary it wouldn’t matter if I was… but I know a thing or two about tort law. Clown World Lawfare aside … that has to be unconstitutional doesn’t it?
If I tried to sign you to a contract where one of the terms and conditions was that I had ownership of you, at my discretion - at the expiration of said contract… and you were dumb enough to sign it… The thing wouldn’t survive its first challenge in court!
I’m gonna say it. Patriotism in this day and age is a liability… if you play by rules when they don’t you’re a sucker and you’ll find yourself at the terrible mercy of Darwin and Murphy.
At that point I'd become the laziest, worst soldier in the army.

DeleteWe didn't have the same term (from what I was aware) in the first Persian Gulf War but we had a similar program.
ReplyDeleteI was on a four-year contract with the Navy. It was supposed to be four years active and four years inactive duty but, come September 1993 at the end of my four years active duty and they said, "Nope!"
I did another seven months before they let me go. All legal in that I had an eight-year long obligation to fill.

DeleteOnce upon a bad time, the US Army had a policy of Stop Loss for any Soldier in any unit for 90 days before or after deployment. But they were rotating units in such a way that they only had 180 days between deployments.
ReplyDeleteThere was at least one guy who was Stop Lossed for four years and three additional combat tours. His parents sued the Secretary of the Army for enslaving their son, as his term of servitude had passed the 8 total years you sign on for with your initial enlistment contract. That made headlines and got the policy changed.
Even the Canadian Army doesn't allow people to leave during war-time. Hence, the reason Canada had so many problems with the draft in both world wars. And, why Pierre Trudeau hid himself in the Laurentians for the duration of the war when he got drafted.
